Course or workshop content that will reside in, or be placed on the Blue Waters system (including software programs and source code) is free of export controls provided it does not involve strong encryption¹ or telecommunications technology (“telecommunications technology” means any information that would be useful in the electronic transmission of data) and if any of the following apply:

• The content has already been made publicly available. “Publicly available” means: generally accessible to the interested public in any form, including (a) publication in periodicals, books, print, electronic or other media available for general distribution for free or at a price that does not exceed the cost of reproduction and distribution; (b) ready availability at libraries open to the public or at university libraries; (c) release at an open conference, meeting, seminar, trade show or other open gathering; and (d) for software, the source code is publicly available for free or at a price that does not exceed the cost of reproduction or distribution.
• The content is or was offered in a course listed in a course catalog for a U.S. academic institution or an associated teaching lab.²
• Any content that does not qualify as publicly available or part of a catalog-listed course arose from non-proprietary basic or applied research, is free to be published, and is intended to be published in the near future.
